mso-bidi-font-size:16.0pt">LUTTE COINTREAU / GUACIMAL S.A</span><span lang="FR">.<span style="mso-spacerun: yes">&nbsp;</span></span></h1>   <p class="MsoNormal" align="right" style="text-align:right"><span lang="FR">&nbsp;&nbsp;<o:p>   </o:p>   </span></p>       <p class="MsoNormal"><b><span lang="FR">Chers Amis des Luttes Syndicales        Guacimal-Cointreau,</span></b></p>   <p class="MsoNormal"><span lang="FR">Une nouvelle saison sentame    Guacimal-Cointreau et, en dpit de timides avances, la situation demeure   extrmement tendue. Vu la dtrioration notable de latmosphre dans les   champs, il nous apparat clairement indispensable de relancer au plus vite   nos campagnes nationales et internationales, ceci surtout en vue de tenir la   compagnie Cointreau  son mot.</span></p>   <p class="MsoNormal"><span lang="FR">En effet, vous trouverez annexe ici une   copie de nos dernires correspondances adresses aux directions de <a href="charriaud.htm">Cointreau</a>   et <a href="lettreguacimal.htm">Guacimal</a> S.A. les 3 et 4 dcembre   derniers, leur signifiant  nouveau les difficults confrontes par les   ouvriers de cette entreprise mais aussi et surtout, le rsultat des   pourparlers mens avec M. Olivier Charriaud, Directeur International du   Marketing de Cointreau, ce novembre 2001.</span></p>   <p class="MsoNormal"><span lang="FR">Participaient  cette rencontre tenue   aux bureaux de M. Charriaud  Paris le lundi 26 novembre 2001, non seulement   le Directeur International de Cointreau S.A. et Madame Yannick ETIENNE de lorganisation   syndicale hatienne Batay Ouvriye mais galement un membre du   Rseau-Solidarit de Peuples Solidaires et dun membre du Collectif   Haiti-France, deux organisations de solidarit internationale.</span></p>   <p class="MsoNormal" style="text-align:justify"><span lang="FR">La   reprsentante de Batay Ouvriye a fait valoir que&nbsp;les informations   distribues par la compagnie Rmy en rponse aux lettres de protestation   contre la situation des travailleurs sont totalement fausses&nbsp;: les   revendications relatives  un changement des conditions de travail,<span style="mso-spacerun: yes">&nbsp;   </span>laugmentation de salaire, le remboursement des dettes, etc sont   lettre morte&nbsp;; que les patrons de la Socit Guacimal refusent et   continuent  refuser toutes ngociations avec le syndicat de la   plantation&nbsp;; et quun engagement de la compagnie Cointreau en appui au   dveloppement de la zone environnante  la plantation dorangers    Guacimal, St. Raphal, notamment des infrastructures routires et de canaux   dirrigation, coles, centre dalphabtisation et de sant,<span style="mso-spacerun: yes">&nbsp;   </span>etc, est indispensable.</span></p>   <p class="MsoNormal" style="text-align:justify"><span lang="FR">M. Charriaud   rpondait principalement aux deux premiers points, en soulignant que   Cointreau ntait quun client de la Compagnie Guacimal, sans   lgitimit de porter un jugement sur le fonctionnement dune autre   entreprise leur fournissant des produits pour la fabrication de leur liqueur,   ni capacit de savoir ce qui se passait  des milliers de kilomtres et que   la position de Cointreau sappuyait sur les informations reues des   directeurs de Guacimal. Il ajoutait que la compagnie Cointreau avait signifi    M. Zephir et  M. Novela, dans une rencontre rcente sur les problmes   avec les travailleurs que Cointreau tait en faveur dun dialogue social en   vue de trouver une solution heureuse au conflit.</span></p>   <p class="MsoNormal" style="text-align:justify"><span lang="FR">A ceci, la   reprsentante de Batay Ouvriye avait soulign que ces patrons refusaient   catgoriquement tout dialogue, affichant un mpris total envers les   reprsentants des travailleurs et envers la lgislation du travail en   vigueur en Haiti. De plus, Batay Ouvriye souhaiterait que la socit   Cointreau envoie quelquun pour sinformer sur place de la situation en   Haiti et initier le processus de ngociation entre les deux parties. Une   autre suggestion qui a t faite par Mme Etienne est quune dlgation   forme de membres du personnel syndiqu de la Socit Cointreau, des   reprsentants des organisations de Solidarit Internationale et de Batay   Ouvriye fasse une visite des lieux et rencontre les parties en conflit pour   arriver  une issue ngocie.</span></p>   <p class="MsoNormal" style="text-align:justify"><span lang="FR">Le Directeur   International Marketing de Cointreau a affirm ne pas pouvoir rpondre   immdiatement  nos suggestions mais quil consulterait ses suprieurs   hirarchiques. Pourtant, lurgence de trouver une solution  nos   proccupations (dautant que<span style="mso-spacerun: yes">&nbsp; </span>la   compagnie Cointreau a toujours dfendu lide dun dialogue social) est   aujourdhui critique et Batay Ouvriye estime que cette rencontre  Paris   devrait avoir des suites immdiates et urgentes. En effet, la saison va   recommencer incessamment et les conditions de travail des ouvriers se   dtriorent sans arrt, leur salaire nullement ajust aussi,<span style="mso-spacerun: yes">&nbsp;   </span>le climat de crise qui se dveloppe depuis plus dun an est devenu   explosif. Les dernires nouvelles venant des travailleurs de la plantation dorangers   sont trs mauvaises: les actes de rpression contre les membres du Syndicat   continuent. Par exemple, des agents de scurit de lentreprise et dautres   personnes armes ont fait irruption en plaine runion du syndicat et ont   profr des menaces de mort contre les membres aprs avoir dit haut et fort   quils venaient de la part de M. Zphir. Puis, ils ont annonc quils naccepteraient   plus la prsence des membres de lIntersyndicale Premier Mai, fdration   syndicale affilie  Batay Ouvriye. Ce dernier incident prouve encore que M. There, he began to present a few     ameliorations concerning the unions list of demands, as if they were of     his own initiative. When the workers, who were aware of the Cointreau     letter, informed him that they had already received the Cointreau     correspondence and they just wanted to know when these ameliorations would     be put in effect, he was terribly vexed.<o:p>     </o:p>     </span></p>     <p class="MsoNormal"><span style="mso-ansi-language: EN-US">Following this,     the loans were never truly eliminated. Though this loan had been negotiated     before the Cointreau correspondence, management has recently forced the     workers to repay these sums by regularly perceiving portions of it from     their paychecks.<o:p>     </o:p>     </span></p>     <p class="MsoNormal"><span style="mso-ansi-language: EN-US">Furthermore,     though Cointreau promised there would be a delegate to negotiate a wage hike     with the union in Novemer, at present the month is finished and nothing at     all has happened. Similarly, the promised doctor and other demands which     were clearly agreed upon between management and the Union have never come     forth.<o:p>     </o:p>     </span></p>     <p class="MsoNormal"><span style="mso-ansi-language: EN-US">With this form     of constant postponing Cointreau and the Zephir brothers Guacimal     management have imposed, the fact of the matter is that they are eating away     at the workers salaries and expenses with regard to their work     conditions, social benefits and so on: the longer they can postpone     putting agreements in application, the more the can continue paying poorly     and spending nothing! When we take into account the poverty of the workers,     adding to the general crisis destroying their lives, we understand how <b>blood-thirsty     </b>these capitalists are!<o:p>     </o:p>     </span></p>     <p class="MsoNormal"><span style="mso-ansi-language: EN-US">In St. Raphael,     the situation is beyond words. Not only havent the Zefirs even accepted     to negotiate with the Union (and so to recognize it formally) despite its     official affidavit, last Saturday Nov. 24<sup>th</sup>, a group of six     watchmen and eight thugs armed with machetes came to break up a meeting which was to be held on     the lands. Given a halt in the orange harvest, there were very few union     members present at the meeting. This allowed the watchmen group to     successfully break up the meeting. Threatening the union members with their     machetes in hand, they declared that management itself had sent     them to break up the meeting! Adding that they would not allow neither Batay     Ouvriye May 1<sup>st</sup> Union Federation activists, nor Batay Ouvriye     militants to enter the lands to discuss with the workers! Let us note that     the meetings agenda was the workers demands and, more specifically,     the work conditions and salary necessary for them to resume work next     January. Precisely that which management did not want planned, so that, in     this manner, they were able to break up the rallying in the womb. More, two     hours after this brutal interruption, the watchmen group headed towards the     Unions General Coordinators home where Batay Ouvriye activists usually     sleep and threatened to burn the house down if ever they returned! For now,     workers continue to meet in small numbers in order to remobilize and be able     to face this situation in which the capitalists categorically refuse them     their right to meet and plan the setting up of their legal demands.<o:p>     </o:p>     </span></p>     <p class="MsoNormal"><span style="mso-ansi-language: EN-US">In all of this,     the watchmen constantly appear in the forefront, but as even they declare it     clearly, it is under orders of the Zephirs themselves! That which clearly     demonstrates how Cointreaus declarations are lies to divert the concrete     understanding of international militants and progressives, as well as the     public in general!<o:p>     </o:p>     </span></p>     <p class="MsoNormal"><span style="mso-ansi-language: EN-US">Once again, all     of these misdeeds would not be possible without the participation of the     Lavalas government which, even though workers had informed even the     executive powers Delegate  therefore the President himself  never     even pronounced itself, talk about acting!</span></p>       <p>&nbsp;</td>     <td width="50%" valign="top">     <h3>Guacimal/Cointreau campaign update -&nbsp;</h3>     <h3>28 November 2001<br>     by the Haiti Support Group</h3>     <p><br>     <br>     On Monday 26th November, a representative of the Haitian workers' movement,<br>     Batay Ouvriye, together with members of the French solidarity organisations,<br>     Collectif Haiti de France and Reseau-Solidarite, met with Olivier Charriaud,<br>     Remy Cointreau's international director, at the company's headquarters in<br>     Paris.<br>     <br>     The delegation asked Charriaud why Remy Cointreau had not pressed its     Haitian<br>     partner, Guacimal SA, to hold reasonable negotiations with the workers'     union<br>     at the processing plant at Madeline, or to recognise the legally-registered<br>     union at the St. Raphael plantation. They pointed out that Remy Cointreau     had<br>     been replying to concerned campaigners with letters stressing that the<br>     company &quot;readily accepts the presence of trade unions,&quot;     &quot;respects workers'<br>     rights,&quot; and &quot;does not tolerate moral or physical harassment&quot;     of its workers.<br>     Yet, the reality at the Guacimal workplaces in Haiti was quite the opposite.<br>     In fact, early in November, the Guacimal management sent a representative to<br>     the St. Raphael plantation to recruit non-unionised workers to begin the<br>     orange harvest. This move was a clear attempt to break the plantation<br>     workers' union.<br>     <br>     Charriaud replied that he was both surprised and dismayed that his company's<br>     standards and norms were not being applied by Guacimal SA. As far as he     knew,<br>     Remy Cointreau and the management of Guacimal SA were agreed on the need to<br>     create a climate of mutual respect with the workers. He claimed to have no<br>     idea that there continued to be a bitter and unresolved dispute between the<br>     workers' unions and the management in the person of Daniel and Nonce Zephyr.<br>     <br>     The delegation supporting the Haitian workers then challenged Remy Cointreau<br>     to face up to its responsibilities in Haiti by sending a fact-finding     mission<br>     to the workplaces and make a genuine attempt to find out about and address<br>     the workers' grievances. They also suggested that the company should finance<br>     independent monitors to report on what was really happening on the ground.<br>     <br>     Charriaud responded positively to these suggestions but said that he was not<br>     authorised to take such decisions and needed to consult with other Remy<br>     Cointreau managers.<br>     <br>     The Haitian workers' unions, Batay Ouvriye, and the international solidarity<br>     groups across the world, are now waiting for a reply from Remy Cointreau to<br>     see if the company is genuinely interested in resolving the dispute or is<br>     just engaged in further delaying tactics. In light of the volume of sales of<br>     the Cointreau liqueur at Christmas-time, the campaigners have decided to     wait<br>     no more than two weeks for Remy Cointreau to reply, and, if no satisfactory<br>     answer is given by then, to re-launch the campaign to hold the company<br>     accountable for the exploitation of Haitian workers.<br>     <br>     Meanwhile, in Haiti on 8th November, the Platform to Advocate for     Alternative<br>     Development (PAPDA) held a solidarity meeting in support of the Guacimal<br>     workers. Around 60 students, journalists and members of the popular movement<br>     attended and heard the PAPDA spokesperson, Camille Chalmers propose the<br>     forming of a committee in solidarity with the Guacimal workers and the<br>     publicising of the negative consequences of globalisation.<br>     <br>     The spokesperson for Batay Ouvriye in northern Haiti stressed the<br>     determination of the Guacimal workers to struggle against their exploitation<br>     in spite of the continuing and fierce repression that they are experiencing.<br>     He also pointed out that the dispute was being perpetuated by leading<br>     representatives of the Haitian oligarchy, the Zephyr brothers, who has<br>     economic interests that extended across that part of the country, notably in<br>     the coffee business. Another feature of the anti-worker offensive was the<br>     collusion of representatives of the Haitian State, in particular at the     level<br>     of the regional office of the Ministry of Social Affairs.<br>     <br>     After hearing a first hand testimony from a Guacimal union leader, the<br>     meeting agreed to intensify the campaign to denounce the exploitation     carried<br>     out by Guacimal and Remy Cointreau, both at home and abroad.
